A person commits a criminal offence if they: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>intentionally injure another person\u2019s body ior damage their health, or<\/li>\n\n\n\n<li>intentionally mistreat someone and thereby negligently cause an injury.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>When Does Bodily Injury Exist in Legal Terms?<\/strong><\/h3>\n\n<p>Bodily injury is <strong>any not entirely insignificant interference with a person\u2019s physical integrity<\/strong>. Examples include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>bruises<\/li>\n\n\n\n<li>contusions<\/li>\n\n\n\n<li>swelling<\/li>\n\n\n\n<li>cuts or scratches<\/li>\n<\/ul>\n\n<p>A brief skin reddening without further impairment is generally not sufficient.<\/p>\n\n<p><strong>Note<\/strong>: Pain alone does not automatically fulfil the legal definition, but it may serve as an indication of an injury.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>What Does \u201cMistreatment\u201d Mean?<\/strong><\/h3>\n\n<p>Mistreatment generally refers to any application of physical force to the body that significantly impairs a person\u2019s physical well-being.<\/p>\n\n<p>Examples include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>kicking<\/li>\n\n\n\n<li>slapping,<\/li>\n\n\n\n<li>pushing someone over<\/li>\n\n\n\n<li>throwing someone to the ground<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>Subjective Intent<\/strong><\/h3>\n\n<p>For bodily injury, <strong>conditional intent<\/strong> with regard to the mistreatment or the bodily injury is sufficient. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>What Penalty Applies to Minor Bodily Injury?<\/strong><\/h3>\n\n<p>Minor bodily injury is punishable by imprisonment of up to one year, or a fine of up to 720 daily penalty units.<\/p>\n\n<p>If the offender commits bodily injury against a driver or inspector of a public transport vehicle, the penalty may be up to two years\u2019 imprisonment.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>When Is Bodily Injury Considered Serious? (\u00a7 84 Austrian Criminal Code)<\/strong><\/h2>\n\n<p>Bodily injury is considered serious if:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the damage to health lasts more than <strong>24 days<\/strong>,<\/li>\n\n\n\n<li>the victim becomes <strong>unable to work for more than 24 days<\/strong>, or<\/li>\n\n\n\n<li>the injury is inherently serious.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>What Is an \u201cInherently Serious Injury\u201d?<\/strong><\/h3>\n\n<p>Whether an injury is \u201cinherently serious\u201d is determined through an overall assessment of the circumstances.<\/p>\n\n<p>Case law considers factors such as: the importance of the affected organ the severity of functional impairment and pain, the duration and uncertainty of the healing process, the risk of complications. Several injuries that are individually minor may, in their overall effect, be considered serious bodily injury. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Penalties for Serious Bodily Injury<\/strong><\/h3>\n\n<p>If the offender intentionally mistreats the victim but causes serious bodily injury only through negligence, the penalty can be up to 3 years\u2019 imprisonment.<\/p>\n\n<p>If the offender intends to cause at least minor bodily injury and thereby \u2013 even if only negligently \u2013 causes serious bodily injury, the penalty ranges from 6 months to 5 years\u2019 imprisonment.<\/p>\n\n<p>In certain special cases, an act that would otherwise be minor bodily injury is legally classified as serious bodily injury and punished with 6 months to 5 years\u2019 imprisonment, for example:<\/p>\n\n<p>If the offender injures a public official, witness, or expert during the performance of their duties;<\/p>\n\n<p>if the bodily injury is committed<\/p>\n\n<ul class=\"wp-block-list\">\n<li>if the bodily injury is committed<\/li>\n\n\n\n<li>in agreement with at least two other persons, or<\/li>\n\n\n\n<li>uby inflicting particular cruelty.<\/li>\n<\/ul>\n\n<p>It should be noted that even more severe penalties apply in cases of bodily injury with serious permanent consequences (\u00a7 85 StGB), bodily injury resulting in death (\u00a7 86 StGB), intentional serious bodily injury (\u00a7 87 StGB).<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>No Criminal Liability in Cases of Self-Defence or Defence of Others<\/strong><\/h2>\n\n<p>Not every act causing bodily injury is punishable. The Criminal Code provides grounds of justification and grounds excluding culpability. An important justification is <strong>self-defence or defence of others<\/strong>. Anyone who protects themselves or others against a <strong>current or imminent unlawful attack<\/strong> on life, health, physical integrity, sexual integrity, or property by means of necessary defence generally acts lawfully.<br\/>    <\/p>\n\n<p>The defence must be the least severe means suitable to repel the attack. However, the defender does not have to take risks regarding the effectiveness of the defensive measure.<\/p>\n\n<p>If the permissible limits of self-defence are exceeded, this is called excessive self-defence. The act is generally unlawful. However, if the excess results solely from shock, fear, or fright, the offender is excused with respect to the intentional offence \u2013 unless the excess results from negligence. In that case, the offender may be liable for negligent bodily injury.  <\/p>\n\n<h2 class=\"wp-block-heading\">Conclusion &amp; Recommended Action in Cases of Bodily Injury<\/h2>\n\n<p>Criminal proceedings for bodily injury can have serious consequences. Often they arise from spontaneous actions, for example during, disputes in road traffic altercations in bars or restaurants, family conflicts. The specific circumstances of each individual case are always decisive.   <\/p>\n\n<p>Even where bodily injury was committed intentionally, criminal proceedings do not necessarily have to end with a conviction. Under certain conditions, the case may be resolved through diversion \u2013 even where serious bodily injury is alleged. Diversion not only avoids an entry in the criminal record but often also offers financial advantages.  <\/p>\n\n<p>For <strong>suspects<\/strong>, a professional defence strategy can make the difference between an acquittal, a conviction, or a diversionary resolution.<\/p>\n\n<p>Therefore: Consult a criminal defence lawyer as early as possible, particularly before a suspect interrogation. One of the requirements for diversion is that the suspect accepts responsibility for the offence, that the guilt is not considered serious, and that there are no special preventive reasons (such as prior convictions) preventing diversion. <br\/><br\/><br\/>If the requirements for diversion are met, the public prosecutor or the court may, for example, propose terminating the proceedings in exchange for the payment of a sum of money, through victim\u2013offender mediation (compensation for damages), or by imposing other measures. Alternatively, the prosecution may provisionally withdraw from prosecution while setting a probationary period.<br\/>The main advantage of diversion is that the suspect does not receive an entry in the criminal record and is not considered to have a criminal conviction.  <\/p> <\/details> <details class=\"schema-faq-section\"  id=\"faq-question-1753430103453\"><summary class=\"schema-faq-question\" >Can I claim damages as a victim in criminal proceedings?<br\/><\/summary> <p class=\"schema-faq-answer\">Yes. Victims may join the criminal proceedings as a private party claimant and assert their claims for damages\u2014including compensation for pain and suffering for both physical and psychological harm\u2014by specifying a concrete amount. If the defendant is convicted, the court may order the defendant, as part of the judgment, to pay damages to the private party claimant.
